You are right and usually I refer to the culprit as "previous owner" so I stand corrected. In fact I am sure it wasn't the guy I got it from because after talking to him I believe his story that after putting 50 miles on it he went and bought a new bike and left it sitting. I initially contacted him about the damage and he was willing to go half on a set of cases and after I let him off the hook he sent a new oem set of mirrors so I was happy about that.
